In some cases, the best means of addressing a dispute may not be through traditional litigation. Rather, because the parties share interests (children, saving money/preserving funds and timely resolution of their dispute), alternative dispute resolution may be the best option. After all, unlike many cases that proceed through the court system, in family law opposing parties often must continue contact for years. Some means of alternative dispute resolution that we can help with are:
  • Mediation – Working with a trained individual to help parties reach an agreement.
  • Binding Arbitration – A arbitrator is privately retained to make a binding decision after the presentation of evidence on legal issues. Arbitration is a quicker means to a final decision than court, usually made by an expert in the issues raised by the parties.
  • Collaborative Divorce – Each party hires counsel and agreement is signed committing to resolve disputes outside of court.
